Terms of service

Last updated: 11 October 2026

1. Who I am

James Hayes Consulting is the trading name of Ross Hayes, 58 Barnes Way, Herne Bay, Kent CT6 6RX. Phone 07500 511462, email enquiries@jameshayesconsulting.com. In these terms, "I", "me" and "my" mean Ross Hayes trading as James Hayes Consulting, and "you" means the person or business buying from me.

2. What these terms cover

These terms apply when you book a service with me (home sessions, courses, business sessions and workshops), buy a gift voucher or a digital product, or use this website. They sit alongside my promise and your right to cancel, my refund policy and my privacy policy.

If you're buying as a consumer, nothing in these terms takes away your legal rights. Citizens Advice can explain them: 0808 223 1133.

3. Prices and payment

  • Prices are shown on this website and are fixed. I'm not registered for VAT, so no VAT is added.
  • Home visits: I confirm the price in writing before the visit, including any travel charge. I never ask for payment in advance for a home visit. You pay by card on the day or by bank transfer afterwards.
  • Travel: there's no travel charge across Canterbury, Whitstable, Herne Bay, Faversham and Thanet. Elsewhere in East Kent it's £15, and £30 for the rest of Kent, always agreed before you book. Further afield, sessions can be held by video call, as two one-hour calls at the same price. For business sessions outside these areas, travel is 45p a mile, agreed before we fix a date.
  • Online purchases (business sessions, gift vouchers and digital products) are paid at checkout. Other business work is invoiced, payable within 7 days.

4. Home sessions and courses

  • When you book, I send a written confirmation of what you've booked, the date, the price and your right to cancel.
  • Please have your phone, tablet or computer charged. You type your own passwords; I never need to know them.
  • My promise applies to every visit. I will never ask for your passwords, PIN or bank details, and I never touch online banking. Family and friends are welcome to sit in, and you can stop a session at any time. I never ask you to decide anything on the day.
  • If I'm ill or can't make it, I'll tell you as soon as I can. You can choose a new date or a full refund of anything you've paid.
  • If something on the day makes a visit unsuitable, for example if someone is unwell, we'll rearrange at no cost.

5. Changing or cancelling a booking

You can cancel a booking within 14 days, for any reason and without charge. My refund policy and cancellation page explain how, including what happens if you ask for your visit to take place within those 14 days.

Need to change the date? Ring or email as early as you can and we'll find another time. There's no charge for rearranging a home visit.

6. Ongoing support

I'm not offering a monthly support plan at the moment. If I bring one back, its terms will be added here before anyone signs up.

7. Gift vouchers

  • A voucher is valid for 12 months from the date it's bought, for the session named on it.
  • It can be passed on to someone else. It can't be exchanged for cash.
  • Travel charges and video sessions work the same way as for any other booking (see section 3). Ring me before you buy if you're unsure.
  • If you change your mind, you can cancel within 14 days of buying for a full refund (see my refund policy).

8. Business services

  • AI Kick-Start: half a day on site, with a written plan within three working days. If, within 60 days, you go ahead with Managed AI or with a build I've quoted at £1,000 or more, the £395 is credited against its price.
  • Team workshop: a full day for up to ten staff, including a one-page safe-use policy.
  • Managed AI and build work are covered by a separate written agreement, including a data processing agreement wherever I handle personal data on your behalf.
  • Rearranging and cancelling: you can rearrange for free with 24 hours' notice. If you cancel before the session, you get a full refund. If I have to cancel, you choose a new date or a full refund.
  • Liability to businesses: my total liability for any claim connected with a service is limited to the price you paid for that service. I'm not liable to a business for loss of profit, business, goodwill or data. This doesn't limit liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

9. Digital products

  • What you get: a download link by email as soon as you've paid.
  • What you can do with it: use it yourself, in your household, or within one organisation. You're welcome to copy and adapt the templates inside for your own household or organisation. Please don't share the file publicly, resell it or publish it.
  • Cancelling: see my refund policy. Once you've started the download, having agreed to it at checkout, the 14-day cancellation right no longer applies. If the file is faulty or not as described, you're still covered.
  • The content is general guidance, correct to the best of my knowledge on the date shown in it. It isn't legal, financial or other professional advice for your particular circumstances. AI tools change often, so check settings and prices on the provider's own website.

10. Advice, AI tools and other companies' services

  • I recommend and help you set up tools made by other companies, such as Apple, Google, Microsoft and OpenAI. Those tools are provided under their own terms, and I'm not responsible for how they work, what they cost, or changes their makers make.
  • AI tools can be confidently wrong. Always check anything important (health, money, legal matters) with a qualified person.
  • I'll show you how to recognise and avoid scams, but no one can guarantee you'll never be targeted.

11. My responsibility to you

  • I carry out every service with reasonable care and skill. If something isn't right, tell me and I'll put it right. Where I can't, you'll get a full or partial refund, as is fair.
  • If you're a consumer, I'm responsible for loss or damage you suffer that is a foreseeable result of me breaking these terms or failing to use reasonable care and skill. I'm not responsible for loss or damage that wasn't foreseeable.
  • Nothing in these terms limits my liability for death or personal injury caused by my negligence, for fraud, or for anything else where that would be unlawful.

12. Complaints

Please ring me first on 07500 511462, or email enquiries@jameshayesconsulting.com, and I'll do my best to put things right. If you're still unhappy, the Citizens Advice consumer helpline (0808 223 1133) can give you free advice.

13. Your information

My privacy policy explains what I collect, why, how long I keep it and your rights.

14. The law

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.

15. Changes to these terms

I may update these terms from time to time. The version on this page on the day you book or buy applies to that booking or purchase.
